1. Introduction and Acceptance of Terms

Welcome to image2color ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website located at image2color.com and our associated services (collectively, the "Service"). By accessing or using the Service, you signify your agreement to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

2. Description of Service

image2color is a web-based utility designed to process user-uploaded images for the purpose of extracting, analyzing, and generating color palettes.

  • Our Service is provided completely free of charge.
  • No user account or registration is required to use the Service.
  • No payments or subscriptions are required or requested.

3. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations. You must be at least 13 years of age, or the age of legal majority in your jurisdiction, to use this Service.

4. Acceptable Use Policy

When using the Service, you must strictly abstain from:

  • Uploading images that contain illegal, harmful, threatening, abusive, offensive, pornographic, or otherwise objectionable material.
  • Uploading images or content that infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party.
  • Using the Service to transmit viruses, malware, or any other malicious code.
  • Attempting to interfere with, disrupt, or compromise the integrity or security of the Service, our servers, or our networks.

5. Intellectual Property

The Service and its original content, features, functionalities, UI/UX design, and source code are and will remain the exclusive property of image2color and its licensors. The Service is protected by copyright, trademark, and other laws of both your jurisdiction and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User Content (Uploaded Images)

You retain all of your ownership rights in your User Content (the images you upload). However, by uploading an image, you grant us a temporary, limited license to process and display the image solely for the purpose of providing the color extraction functionality to you.

  • No Liability for Content: You are solely responsible for the images you upload. We assume no responsibility or liability for any User Content.
  • Transient Processing Only: Uploaded images are processed temporarily. We do not intentionally permanently store, archive, or maintain backups of the images you upload.

7. Third-Party Services

Our Service integrates with certain third-party tools to monitor performance, analyze user behavior, and ensure reliability. Specifically, we use Google Analytics and Vercel Analytics. These services may utilize cookies or tracking technologies to automatically collect diagnostic and usage data. Your interaction with these third-party services is governed by their respective privacy policies and terms of use.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

  • We do not warrant that the Service will be uninterrupted, totally secure, or error-free.
  • We make no guarantees regarding the accuracy, reliability, or correctness of the extracted color results.
  • We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMAGE2COLOR, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Indemnification

You agree to defend, indemnify, and hold harmless image2color and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, including but not limited to uploading infringing or illegal User Content.

11. Termination of Access

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate the date of the latest revision at the top of this document. It is your responsibility to review these Terms periodically for updates. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
